Each family must complete and return this form with a 35% deposit to conﬁrm reservations; US$500 per person of this is nonrefundable (NRD). Air payment is due immediately upon confirmation and non-refundable in case of cancellation. Higher deposit amounts may be required for holiday travel. We accept the deposit payment on credit card (MC, Visa or Amex). For large groups a 3% fee may be charged; contact us for alternate payment methods in these cases. Cost of Galapagos ﬂights (from the Ecuadorian mainland) is subject to change without notice, even if a deposit has been paid on the trip.
Final balance payment is due 90 days before travel. The remaining balance can be paid by check or wire payment. Latin Excursions Inc. reserves the right to cancel reservations if payments are not made. No one will be allowed to depart on a trip unless all payments and necessary documents have been received by Latin Excursions.
Cancellation must be in writing. If trip cancels more than 90 days from departure it will be assessed a US$500 per person nonrefundable deposit plus any penalties imposed by Latin Excursions suppliers. Within 90 days, cancellation fees are as follows:
Prior to Travel
90-61 days nonrefundable deposit + 35% total price of the trip.
60-31 days nonrefundable deposit + 65% total price of the trip.
30-00 days 100% price of the trip (no refunds).
During Trip — No Refunds
In addition to the above, any cancellation penalties imposed on Latin Excursions by its suppliers will be charged to the passenger. No refunds will be made for missed meals or tours.
All changes are subject to a change fee. Air tickets may be non-refundable and may incur penalties for charges or loss tickets.
Although Latin Excursions will make every effort to adhere to the itinerary and terms stipulated here, at Latin Excursions sole discretion it may be necessary to adjust. Should this happen, the best feasible substitution will be made and no refund given.
Our standard and custom itineraries are priced as complete packages including: transportation where available, deluxe and/or luxury accommodations, professional guides, private tours, and noted activities. Latin Excursions is not able to itemize costs. Prices quoted are in US$ on a per person basis. Prices are subject to change due to monetary ﬂuctuations.
Travelers need a passport in good condition and valid for at least 6 months at time of travel. Please contact the local consulate or a visa service for speciﬁc visa requirements. We are not responsible for losses of any kind due to problems with travel documents. It is the responsibility of the passenger(s) to have all necessary travel documents in order.
Tours are as listed in the itinerary chosen. English-speaking guides (other languages under request – a supplement may apply) will be provided for all tours & transfers (except if Travel documents including Trip Concept state differently). Accommodations will be provided as specified in the final itinerary, barring unforeseen circumstances. Meals are included where mentioned in the itinerary.
Check with airlines to conﬁrm their luggage allowance. Many allow a maximum of 44 lb/20 kg per checked bag and some charge for checked baggage. Latin Excursions is not responsible for lost, stolen or damaged baggage or personal belongings.
We strongly recommend purchasing travel insurance. Please contact us to arrange a quote for you.
Vaccines & Health Requirements
It is recommended that all passengers consult with their personal physician for any vaccination or drug recommendations. Vaccinations requirements vary according to the country.
NOT INCLUDED IN THE TOUR PRICE
Passports, visas, tourist cards, vaccinations, laundry costs, alcoholic beverages, meals not speciﬁed in the travel program, excess baggage charges, personal and baggage insurance, health insurance, services not included in the tour programs and other items of a personal nature. NOTE: Additional land costs incurred due to change of airline scheduling are NOT included. All airline schedules are SUBJECT TO CHANGE and Latin Excursions is not responsible for any additional costs as the result of missed connections or ﬂight changes.
Latin Excursions, Inc., its employees, shareholders, subsidiaries, aﬃliates, oﬃcers, directors, successors, and assigns (collectively “Latin Excursions”) does not own or operate any entity which is to or does provide goods or services for your trip including, for example, lodging facilities, airline or other transportation companies, guides or guide services, local ground operators (whether or not they use Latin Excursions’ name), food service providers, etc. As a result, Latin Excursions is not liable for any negligent or willful act or failure to act of any such person, or of any other third party. Without limitation, Latin Excursions is not responsible for any injury, loss, or damage to person or property, death, delay, or inconvenience in connection with the provision of any goods or services occasioned by or resulting from, but not limited to, acts of God or force majeure, acts of war or civil unrest, insurrection or revolt, strikes or other labor activities, criminal or terrorist activities of any kind or the threat thereof, overbooking of accommodations, mechanical or other failure of airplanes or other means of transportation or for any failure of any transportation mechanism to arrive or depart timely, attacks or other actions of wild or domestic animals, disease, epidemics or the threat thereof, sanitation problems, lack of medical care and/or access to same, the negligence of Latin Excursions, or for any other cause beyond its direct control.
ASSUMPTION OF RISK
Adventure travel can be dangerous and includes certain risks and dangers, including, but not limited to, the hazards of traveling in undeveloped areas, hazards of traveling by boat, canoe, raft, train, automobile, aircraft, on foot, by animal or by other unconventional means, accident or illness in remote places without medical facilities or easy access thereto, dangers of wild or domestic animals, forces of nature, lack of sanitation, criminal and/or terrorist activity or the threat thereof, epidemics or the threat thereof, sickness or injury and the inability promptly to evacuate to appropriate medical facilities, extreme weather conditions, physical exertion for which client is not be prepared, and evacuation diﬃculties. I accept the inherent risks of the proposed trip and acknowledge that the enjoyment of adventuring beyond normal safety of home and work is in part the reason for my participation on this trip. As a result, I hereby release Latin Excursions from all or any liability to the undersigned, his/her personal representatives, heirs, assigns and next of kin, from any and all losses, damages, death, inconvenience or injuries to the person or damage or loss of property of the undersigned, or on account of death, injury, loss or inconvenience resulting from any cause, including negligence of Latin Excursions or the negligent or willful conduct of others while the undersigned is participating in a tour or any travel or other arrangements made by Latin Excursions.
TRIP CANCELLATION BY LATIN EXCURSIONS
Latin Excursions reserves the right to cancel any trip due to insufficient sign-ups or for other reasons. In the event of cancellation by Latin Excursions, a full refund of payments on land costs will be given. Latin Excursions is not responsible for any expenses incurred by trip members such as equipment, medical costs, air tickets, babysitting fees, etc.
We strongly recommend you protect yourself and your baggage with a short term traveler’s insurance policy, available through Latin Excursions, your travel agent or elsewhere. Baggage is carried entirely at owner’s risk; Latin Excursions assumes no liability whatsoever for damage, loss or delay of property. Trip cancellation insurance, subject to the policy limitations and exclusions, will cover certain losses on non-refundable air and land costs on trips canceled due to illness.
Changes in itinerary may be made at the discretion of Latin Excursions or your local ground operator but only in the event of strikes, natural disasters and comparable circumstances beyond control. Any purchase of goods or services which client makes while on the trip are solely at client’s risk, including, without limitation, such problems as defects, failure to ship or damage to goods while in shipment, whether or not the purchase was made from a vendor recommended by a guide, other person rendering trip services or any third party. I agree that if I am injured or become ill, Latin Excursions may, at my cost, attempt to arrange medical treatment, evacuation or any other emergency services on my behalf as it deems essential for my safety and well-being. I accept responsibility to have all my passport, visa, vaccination and other travel documentation in proper order. I realize I may contact the embassies or consulates of the countries I plan to visit for information, and that my passport may have to have a certain number of fully blank pages and be valid for at least six months after the trip ends. For information concerning possible safety issues for international travel I acknowledge that I may contact the State Department, and for information concerning vaccinations and health issues I may call the “Centers for Disease Control” at 404-639-3534. Latin Excursions and your local operators of tours and/or suppliers of services reserve the right to remove anyone from a trip without refund who acts in a manner which is unsafe or inconsiderate to fellow travelers, or others and/or who ignores the requests of his or her guide(s) to act in a safe and considerate manner. Photographs or movies can be made of participants and used without cost by Latin Excursions in support of its marking efforts. No changes in this Agreement can be made except by a writing signed by an officer of Latin Excursions. Prices are subject to change without notice due to currency fluctuations, and/or other causes.
Any controversy or claim arising out of or relating in any way to this Agreement, any promotional literature, representations, or other information relating in any way to the trip, or the trip itself, shall be settled solely and exclusively by binding arbitration in Dade County, Florida in accordance with the commercial rules of the American Arbitration Association then existing. In any such arbitration Florida substantive law shall apply. The arbitrator and not any federal, state, or local court or agency shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, conscionability, or formation of this contract, including but not limited to any claim that all or any part of this contract is void or voidable.
